Whereas by deed, bearing date of August 11, 1866, and recorded
in Book No. 38 page 122 of the Registers office for Davidson
County Tennessee, W. F. Demoss and others conveyed to James
L. Greer certain real estate situated in the 14th Civil District
of said County, and fully described in said Deed, and
Whereas said James L. Greer departed this life, intestate
seized and possessed of said real estate and several other
tracts of land in the same Civil District and left surviving
him as his sole heirs at law three sons to wit, John T.
Greer, James L. Greer and J. Silas Greer, in whom the title
to said lands rested as tenants in common, and whereas
the said John T. James L. and J. Silas Greer made partition
of said lands amongst themselves wherein and whereby
the two tracts or parcels hereinafter referred to, being parts
of said Demoss tract were assigned to John L. Greer but
said Partition was never recorded, and whereas by Deed bearing
date of January 31, 1874, and recorded in the Registers’ office
aforesaid in Book 50 Page 510, John T. Greer and wife
Mrs. L. J. Greer conveyed to W. S. Smith sixty five/65/ acres
more or less of said land fully described in said deed, to
which reference is made for particulars, and by deed dated
Sept. 16, 1880, and recorded in said Register’s office, in book No
66 pp 602 & 603, said Smith and wife Mary E. Smith
conveyed said 65 acre tract of land to N. M. Morton the
present owner thereof, and whereas by deed dated Feby 19, 1874
and duly recorded in said Register’s office in Book No
51 pp 20 & 21 said John T. Greer conveyed to N. M. Morton
one hundred and thirteen /113/ acres more or less of said
land fully described in said deed to which reference is
made for particulars and by deed dated May 23, 1878, and
recorded in said Register’s office in Book No 60 page 363
N. M. Morton conveyed 113 acre tract to his wife Mrs.
Sarah A. Morton the present owner thereof and whereas
the undersigned desire to perfect the title of said Morton and
wife to said two tracts of land. Therefore in consequence of
the premises and in consideration of the sum of Five
/$500/ Dollars to us paid, We James L. Greer and J. Silas Greer
do by these presents, quit claim, relinquish and convey unto the
said N. M. Morton and wife Mrs. Sarah A. Morton their heirs
and assigns all the right, title, claim and interest of every
kind and character, legal and equitable, that we have in or to
the 65 acre tract of land described in the deed from John T.
Greer and wife to W. S. Smith recorded in Book No 50 page
510 of said Registers office and the 113 acre tract of land
described in the Deed from John T. Greer to N. M. Morton
recorded in Book No 51 pp 20 & 21 of said Registers office
special reference is made to both said Deeds for a correct
description of said two tracts of land but the graveyard on
said 113 acre tract is specially reserved & not conveyed. To
have and to hold said real estate, with all the hereditaments
and appurtenances thereto belonging to said N. M. Morton
and wife Mrs. Sarah A. Morton their heirs and assigns
forever. And I Mrs. Luzany P. Greer widow of James L.
Greer, deceased, join herein and release and convey unto the
said N. M. Morton, and wife Mrs. Sarah A. Morton, their heirs
and assigns forever, all the right title claim and interest
of every kind and character, that I have in or to the
two tracts of land of 65 acres and 113 acres respectively
herein before referred to: especially all the right and title that
I have herein as one of the heirs at law of Thomas Demoss
deceased. Reference is had to the deed recorded in Book
No 38 page 122 from Thomas Demoss heirs to
the said James L. Greer, Witness our hands this November
